I would like to get my C64 running again but when I start it up it comes up saying "out of memory error" is there a way to fix it or does some thing needs to be replaced.

According to the table, found elsewhere on this site
here , your problem is with the "4164 Memory RAM".
Might need to replace the chipsest.
